§ 1 General Provisions, Scope

(1) The consumer (hereinafter referred to as “Customer”) within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes which are predominantly neither commercial nor self-employed professional activity (§ 13 BGB).

(2) All services provided by Wladimir Stoljarov (thus www.geschichtshandwerk.de) for the Customer are carried out exclusively on the basis of the following General Terms and Conditions. Deviating regulations are only valid if they have been agreed upon between www.geschichtshandwerk.de and the Customer or are expressly stated in these General Terms and Conditions.

§ 2 Conclusion of Contract and Storage of Contract Text

(1) The contract language is German. The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog.

(2) After entering your personal data and clicking the “Buy” button in the final step of the ordering process, you submit a binding order for the goods contained in the shopping cart. www.geschichtshandwerk.de is entitled to accept this offer within 5 calendar days by sending an order confirmation. The order confirmation is sent via email. If the 5-day period expires without acceptance, the offer is deemed rejected.

(3) The confirmation of receipt of the order is sent immediately after the order is submitted. However, the purchase contract is only concluded upon our order confirmation or delivery of the goods.

(4) The conclusion of a purchase contract for commissioned work takes place only after detailed agreement between the Customer and www.geschichtshandwerk.de with final order placement (via email, telephone, or postal mail) to www.geschichtshandwerk.de by the Customer.

(5) In the case of advance payment, the contract is concluded with the provision of the bank details and the payment request. If payment is not received despite being due and after a reminder within 10 calendar days after sending the order confirmation, the seller will withdraw from the contract, resulting in the order being void and the seller having no obligation to deliver. In such cases, the order is considered canceled for both buyer and seller without further consequences. Reservation of the item in case of advance payment is therefore limited to a maximum of 10 calendar days.

(6) The contract text (your order) will be stored. You can access the general contractual terms and conditions (GTC) at any time at www.geschichtshandwerk.de/agb and save them on your computer. The specific order data will be sent to you by email.

§ 3 Payment, Due Date, Default

(1) Payment for goods is made in advance or via PayPal service. www.geschichtshandwerk.de reserves the right to accept or exclude certain payment methods in individual cases.

(2) In the case of payment in advance or via PayPal, the Customer undertakes to pay the purchase price immediately after the conclusion of the contract.

(3) If the Customer is in default of payment, he is responsible for any negligence during this period. He is liable for performance even for accidental loss, unless the damage would have occurred even with timely performance.

(4) The purchase price is subject to interest during the period of default. The default interest rate is five percentage points per year above the base interest rate. In transactions in which a consumer is not involved, the interest rate is eight percentage points above the base interest rate.

(5) The assertion of further damages is not excluded.

(6) Unless otherwise specified by www.geschichtshandwerk.de, vouchers are valid indefinitely for redemption of the defined amount stated on the voucher.

(7) Vouchers are non-transferable and can be redeemed on the website using the provided voucher code.

(8) The voucher amount will be offset against the total value of the ordered goods. If the total value exceeds the value of the voucher, the remaining amount must be paid in accordance with §3 paragraphs 1–2 of these GTC.

(9) If the total value of the ordered goods is less than the voucher amount, the remaining value of the voucher can be redeemed at a later date using the same voucher code.

§ 4 Delivery

(1) Delivery is made by sending the goods to the address provided by the Customer. Delivery takes place within one week after receipt of the order by postal package directly to the home address, unless otherwise stated in the product description. Custom-made items are delivered within a timeframe agreed with the Customer. These details are non-binding unless otherwise agreed.

(2) Delivery is subject to the packaging and shipping costs specified during the online order process. For deliveries abroad, unless otherwise stated, the cost of packaging and shipping will be charged separately. If the Customer requests a special type of shipment that incurs higher costs, these additional costs must also be borne by the Customer.

(3) If performance is not available for reasons beyond our control, the consumer will be informed immediately and any payments already made will be refunded.

(4) Delivery abroad is only made against advance payment.

§ 6 Retention of Title

The goods remain the property of www.geschichtshandwerk.de until full payment has been made. Prior to the transfer of ownership, pledging, transfer of ownership by way of security, processing, or transformation without the express consent of www.geschichtshandwerk.de is not permitted.

§ 7 Prices

(1) The price stated for our goods is the final price including any applicable VAT and other price components. The price does not include delivery and shipping costs.

(2) With the update of the website of www.geschichtshandwerk.de, all previous prices and other information about goods become invalid.

(3) The price at the time the Customer submits the offer is decisive for invoicing.

§ 8 Return Costs in the Event of Withdrawal

If the consumer exercises his right of withdrawal (see cancellation policy), he shall bear the regular costs of returning the goods.

§ 9 Withdrawal

(1) www.geschichtshandwerk.de is entitled to withdraw from the contract, including with regard to any outstanding part of the delivery or service, if false information has been provided about the Customer’s creditworthiness or if objective reasons regarding the Customer’s solvency arise, and if the Customer, upon request from www.geschichtshandwerk.de, neither makes an advance payment nor provides adequate security before delivery, or if insolvency proceedings are initiated against the Customer’s assets or the initiation of insolvency proceedings is rejected due to lack of sufficient assets.

(2) Without prejudice to the damage claims of www.geschichtshandwerk.de, in the event of partial withdrawal, services already rendered must be invoiced and paid for in accordance with the contract.

§ 10 Warranty

The warranty is provided in accordance with statutory provisions.

§ 11 Limitation of Liability

(1) For damages other than those arising from injury to life, body, or health, www.geschichtshandwerk.de is only liable if these damages are based on intentional or grossly negligent conduct or on culpable violation of a material contractual obligation by www.geschichtshandwerk.de or its vicarious agents. Any further liability for damages is excluded. The provisions of the Product Liability Act remain unaffected.

(2) According to the current state of technology, data communication over the Internet cannot be guaranteed to be error-free and/or available at all times. Therefore, the online shop is not liable for the continuous availability of www.geschichtshandwerk.de.

§ 12 Place of Jurisdiction

All disputes arising from this legal relationship are subject to the law of the Federal Republic of Germany. The application of EU or UN sales law is excluded. If the contracting parties are merchants, the court at the place where www.geschichtshandwerk.de has its registered office has jurisdiction, unless an exclusive place of jurisdiction is established for the dispute.

§ 13 Severability Clause

Should any provision of these GTC be invalid or unenforceable, the remaining provisions of these GTC shall remain unaffected.
